Terms of Service

These Terms of Service ("Terms") govern your use of the Youngr mobile application ("App") operated by Legacy Media Korlátolt Felelősségű Társaság ("Legacy Media Kft.", "we", "us", or "our"), a Hungarian limited liability company with its registered office at 1054 Budapest, Honvéd utca 8. 1. em. 2. ajtó, Hungary, registered with the Fővárosi Törvényszék Cégbírósága under company registration number Cg.01-09-450707, EU VAT number HU32943159. By creating an account, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you are at least 18, have the legal capacity to enter into these Terms, and are not barred from receiving services under the laws of Hungary, the European Union, or your country of habitual residence.

We do not knowingly allow minors to create accounts. If we discover a minor has registered, we will terminate the account and delete associated data.

2. Description of Service

Youngr is a nutritional information tool, operated by Legacy Media Kft., that uses artificial intelligence to estimate the nutritional content of meals from photos. The App provides general nutritional information for educational purposes only.

The App is NOT a medical device and does NOT provide:

  • Medical advice, diagnosis, or treatment
  • Allergen detection or food safety analysis
  • Dietary prescriptions or meal plans for medical conditions
  • Supplement dosage recommendations
  • Any service that requires a licensed healthcare professional

The App is not certified or registered as a medical device under the U.S. Food and Drug Administration (FDA), the EU Medical Device Regulation (MDR), or Hungarian medical-device rules, and the estimates it produces should not be used to make clinical, medical, or therapeutic decisions. Always consult a qualified healthcare professional before making changes to your diet or supplementation.

3. AI-Generated Content Disclaimer

Nutritional estimates provided by the App are generated by artificial intelligence and are approximate. AI-based food identification has inherent limitations:

  • Estimates may not accurately reflect actual nutritional content.
  • The AI may misidentify foods, portions, or ingredients.
  • Hidden ingredients (oils, sauces, seasonings) may not be detected.
  • Nutritional values may vary based on preparation methods, brands, and sourcing.

Do not rely on the App for food allergies, medical dietary needs, or any health condition that requires precise nutritional tracking. These statements have not been evaluated by the U.S. Food and Drug Administration; any claim made within the Service is not an authorized health claim under EU Regulation (EC) No 1924/2006. The Service is not intended to diagnose, treat, cure, or prevent any disease.

4. User Accounts

Accounts are initially created anonymously using a randomly generated identifier. You may later link your account to a verified identity provider (Apple or Google) to restore your data across devices.

You are responsible for:

  • Maintaining the security of your device and identity provider credentials.
  • All activity that occurs under your account.
  • Notifying us promptly of any suspected unauthorized access ([email protected]).

If you lose access to your device and have not linked an identity provider, your account cannot be recovered.

5. Subscriptions, Billing, and Auto-Renewal

Youngr offers a free tier and paid subscriptions to "Youngr Premium".

Free tier includes:

  • Account creation, onboarding, and your initial Nutritional Age estimate computed from your onboarding answers
  • Profile management (update your details, delete your account)
  • A blurred preview of your scan history
  • Read access to in-app legal information

Meal scanning is a Premium-only feature. A free account does not include any meal scans; tapping the Scan tab or scan CTA opens the paywall.

Premium subscription includes:

  • Meal scanning from camera or gallery, without daily limits
  • The complete micronutrient breakdown for each scan
  • Personalized food and supplement suggestions based on your scans and onboarding profile
  • Full, unblurred access to your scan history
  • Any future Premium-only features released during your subscription period

Billing disclosures:

  • Price, billing frequency, free-trial length (if any), and renewal terms are disclosed on the paywall screen before purchase.
  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. Apple and Google act as the merchant of record and remit applicable consumption taxes (including VAT in the EU and other jurisdictions).
  • SUBSCRIPTIONS AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS CANCELED AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT BILLING PERIOD.
  • Renewal price will be the then-current subscription price disclosed in the App Store or Google Play.
  • Free trials (if offered) convert to a paid subscription at the end of the trial unless canceled before the trial ends.
  • You will receive a receipt and cancellation instructions from the App Store or Google Play following purchase.
  • All subscription charges are handled by Apple or Google and subject to their payment terms.

EU consumer right of withdrawal: under Directive 2011/83/EU and Hungarian Act CXXV of 2014, you have a 14-day right of withdrawal for digital services. By purchasing a subscription and starting to use Premium features immediately, you expressly consent to begin performance during the withdrawal period and acknowledge that you lose your right of withdrawal once performance has begun.

Refunds:
Refund eligibility is determined solely by Apple App Store or Google Play Store policies. We do not process direct refunds for in-app purchases.

6. Cancellation — Easy, Anytime

You may cancel your subscription at any time, without penalty:

  • iOS: Settings > [Your Name] > Subscriptions > Youngr > Cancel Subscription
  • Android: Google Play Store > Menu > Subscriptions > Youngr > Cancel

Cancellation takes effect at the end of the current billing period. You retain access to Premium features through the remainder of that period. We do not use dark patterns, hidden steps, confirmation phone calls, or retention flows designed to make cancellation more difficult than signup.

7. Account Deletion and Data Removal

You may delete your account at any time from the Profile screen inside the App. Account deletion is permanent and results in:

  • Removal of all personal data from our database within 24 hours.
  • Permanent deletion of all meal images from storage within 24 hours.
  • Cancellation of any active subscription at the end of the current billing period (refund subject to App Store or Google Play policies).
  • Removal or irreversible de-identification of all analytics identifiers.

This action cannot be undone. Retain a copy of any data you wish to keep before initiating deletion.

8. Acceptable Use

You agree not to:

  • Use the App for any purpose other than personal nutritional tracking.
  • Attempt to reverse-engineer, decompile, or extract the AI models, prompts, or algorithms.
  • Upload images that do not depict food or beverages, or that contain unlawful, infringing, or harmful content.
  • Use the App to provide medical advice or dietary prescriptions to others.
  • Resell, redistribute, commercially exploit, or white-label the App or its content.
  • Interfere with or disrupt the App's infrastructure or other users' access.
  • Attempt to circumvent subscription, rate-limit, or anti-abuse controls.

We may suspend or terminate accounts that violate these rules, with or without notice.

9. Intellectual Property

The App, including its design, code, AI models, prompts, branding, and content, is operated by Legacy Media Kft. and protected by Hungarian, European Union, U.S., and international intellectual property and database laws. "Youngr" is the brand and product name under which the Service is offered; it is not currently a registered trademark, but its unauthorized use in a manner that creates confusion with our Service is not permitted. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Meal images you upload remain your property. By uploading images, you grant us a worldwide, royalty-free, non-exclusive license to process, store, and display them as part of your scan history for the duration of your account, strictly to provide the Service.

We do not train foundation models on your images. We may use fully aggregated, de-identified metrics (e.g., global usage counts) to improve the App.

10. Copyright Complaints

a) United States — DMCA. If you believe content in the App infringes your United States copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to [email protected] with: identification of the copyrighted work; identification of the allegedly infringing material and its location; your contact information; a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act; and your physical or electronic signature.

b) European Union — DSA / Notice and Action. If you believe content in the App infringes your copyright or is otherwise unlawful under EU or Hungarian law, you may submit a notice in accordance with Article 16 of Regulation (EU) 2022/2065 (Digital Services Act) and Hungarian Act CVIII of 2001. Send notices to [email protected] with a substantiated explanation, the location of the content, your name and contact information, and a statement of good faith. We will acknowledge receipt and inform you of our decision and the available redress channels.

11. Third-Party Services and App Stores

The App relies on third-party services, including Apple App Store, Google Play, Cloudflare, Google (Gemini AI), Supabase, RevenueCat, Superwall, Sentry, and PostHog. Your use of the App may be subject to their respective terms.

If you obtained the App from the Apple App Store, you acknowledge that the Apple Licensed Application End User License Agreement (EULA) applies, that Apple has no obligation to furnish maintenance or support, and that Apple is a third-party beneficiary of these Terms with the right to enforce them.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEGACY MEDIA KFT., ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • HEALTH OUTCOMES RESULTING FROM RELIANCE ON NUTRITIONAL ESTIMATES.
  • ALLERGIC REACTIONS OR ADVERSE HEALTH EVENTS.
  • LOSS OF DATA OR SERVICE INTERRUPTIONS.
  • INACCURATE OR INCOMPLETE NUTRITIONAL INFORMATION.
  • LOST PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US (THROUGH THE APP STORES) IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100 (OR EUR EQUIVALENT).

NOTHING IN THESE TERMS LIMITS OR EXCLUDES (a) LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, (b) LIABILITY FOR FRAUD OR FRAUDULENT MISREPRESENTATION, (c) LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER HUNGARIAN, EU OR OTHER APPLICABLE MANDATORY CONSUMER LAW, OR (d) THE STATUTORY RIGHTS OF CONSUMERS IN THE EUROPEAN UNION OR YOUR COUNTRY OF HABITUAL RESIDENCE.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITIONAL ESTIMATES WILL BE ACCURATE. THIS SECTION DOES NOT AFFECT MANDATORY STATUTORY WARRANTIES YOU MAY HAVE AS A CONSUMER UNDER EU OR HUNGARIAN LAW (INCLUDING THE DIGITAL CONTENT AND DIGITAL SERVICES DIRECTIVE 2019/770).

14. Indemnification

You agree to indemnify, defend, and hold harmless Legacy Media Kft., its affiliates, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from (a) your use or misuse of the App, (b) your violation of these Terms, or (c) your violation of any rights of a third party. This obligation does not apply to the extent prohibited by mandatory consumer-protection law applicable to you.

15. Dispute Resolution

READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

a) Informal resolution. Before filing any formal claim, please contact [email protected] and describe your concern. We will work in good faith to resolve disputes informally within 30 days.

b) Consumer users in the European Union. If you are a consumer resident in the EU, the European Economic Area, or the United Kingdom, mandatory consumer-protection laws of your country of habitual residence apply, and any dispute may be brought before the courts having jurisdiction at your domicile or those of Legacy Media Kft. The European Commission's Online Dispute Resolution (ODR) platform is available at https://ec.europa.eu/consumers/odr; our email for that platform is [email protected]. Hungarian consumers may also turn to the relevant conciliation body (békéltető testület) of their place of residence.

c) All other users. For users not covered by paragraph (b), any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be brought exclusively before the competent courts of Budapest, Hungary.

d) No class actions. To the extent permitted by applicable law, you and Legacy Media Kft. agree to bring any claim in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative action.

16. Governing Law

These Terms are governed by the laws of Hungary, without regard to its conflict-of-law principles, and to the extent applicable by mandatory rules of European Union law. Nothing in this section deprives you of the protection afforded to consumers by mandatory provisions of the law of the country in which you have your habitual residence.

17. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, strikes, epidemics, pandemics, governmental action, power outages, internet or telecommunications failures, or third-party service outages.

18. Severability, Assignment, and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms freely. These Terms (together with the Privacy Policy and any additional terms referenced herein) constitute the entire agreement between you and Legacy Media Kft. regarding the App.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-app and the "Last updated" date will be revised. If changes materially affect your rights, we will request your acceptance before they take effect. Continued use of the App after non-material changes constitutes acceptance.
